


State Rep. Jamie Thompson has sent a letter to Senate Majority Floor Leader Sam Singh urging action on bipartisan plans she has spearheaded that will provide peace of mind for Michigan families.
House Bills 4418-19, which received unanimous support in the Michigan House in September, would allow an incapacitated patient’s next of kin to participate in medical decision-making when no patient advocate designation is in place. More than 30 states already have this type of surrogate framework in place, but Michigan families are often forced into the guardianship system so care can proceed.
“This process is time-consuming, costly, and emotionally burdensome for patients and families alike,” the letter states. “Hospitals, providers, and patient advocates agree that this change supports timely care, honors patient values, and avoids unnecessary court involvement while maintaining clear medical and legal standards for determining a patient’s capacity.”
Michigan Attorney General Dana Nessel and state Representatives Angela Witwer and Kelly Breen joined Thompson in the letter underscoring the need for Senate action on the bills. Witwer joined Thompson in sponsoring the bills when they were introduced.
Thompson said many families, including hers, have dealt with this issue personally and been confronted with a legal system that gave them no clear path or authority when a loved one could not make their own informed medical decisions.
“In these moments, families should not have to deal with red tape or court proceedings. They should be able to decide on care options and devote their energy to supporting loved ones in need,” said Thompson, of Brownstown Township. “By advancing House Bills 4418 and 4419, Michigan would align with national best practices, reduce delays in care, and ensure that families can act when these situations arise.
“Many Michigan families have already suffered from our current confusing policies. More delays with these bipartisan bills mean another family may go through the same issues. No more delays. Let’s get this done so we can protect Michigan patients and families.”
